Abstract

ABSTRACT.

Purpose – This study aims to examine the effectiveness of mediation in resolving divorce cases at the Religious Court of Pangkalan Kerinci, Pelalawan Regency, and to identify factors that support and hinder the success of mediation.

Methodology – The research employs a qualitative descriptive approach. Data were collected through field observations, direct interviews with relevant informants, and documentation of divorce cases from 2021 to 2023.

Findings – Findings indicate that the success rate of mediation in divorce cases remains low, with 8.3% in 2021, 13.3% in 2022, and 15.1% in 2023. Supporting factors include openness of the parties involved, mediator empathy and positive attitude, attendance during mediation, and equality in the process. Hindering factors consist of strong desire to divorce, prolonged conflicts, psychological issues, involvement of third parties, bad intentions, absence of one party, and reluctance to compromise.

Originality/Novelty – This study is unique because it specifically analyzes mediation effectiveness at the Religious Court of Pangkalan Kerinci, a less-studied area, by focusing on both internal and external factors influencing mediation success.

 Implications – There is a need to improve mediator capacity, strengthen court regulations, and enhance legal education for the community to support mediation as a more effective and humane dispute resolution method in divorce cases.
