KASUS PERDATA DAN PIDANA MONOPOLI DAN PERSAINGAN USAHA (KPPU)

This study examines the application of law by the KPPU in two major cases, namely Indomaret–Alfamart regarding alleged monopoly and Grab–TPI regarding discrimination and abuse of dominant position. Using normative juridical methods and descriptive analysis, the study assesses the enforcement of the principles of fair business competition based on Law No. 5 of 1999. The results, KPPU did not find collusion in the Indomaret–Alfamart case but recommended a zoning policy, while in the Grab–TPI case, discrimination was proven and a fine was imposed. Both cases demonstrate the challenges of law enforcement in the midst of an oligopolistic market and the digital era.
