Abstrak

This study discusses civil and criminal cases in labor law involving disputes between workers and national companies, based on Law No. 13 of 2003 on Manpower, Law No. 2 of 2004 on Industrial Relations Dispute Settlement, and the Indonesian Criminal Code (KUHP). Conflicts between workers and companies commonly arise from differences in fulfilling workers’ rights, such as wages, job security, and termination of employment. Civil cases usually occur due to breaches of employment contracts, while criminal cases arise when companies violate legal provisions containing criminal elements, such as paying wages below the minimum standard as regulated in Article 185 of the Manpower Law, or committing acts of worker exploitation as stipulated in Article 333 of the Criminal Code. The purpose of this study is to analyze the implementation of law in resolving disputes between workers and national companies, both through civil proceedings in the Industrial Relations Court and criminal proceedings in general courts.
