Efektivitas Mediasi Dalam Menyelesaikan Kasus Perceraian (Studi Kasus Pada Pengadilan Agama Pangkalan Kerinci Kabupaten Pelalawan)

Abstrak

Purpose – This study aims to examine the effectiveness of mediation in resolving divorce cases at the Religious Court of Pangkalan Kerinci, Pelalawan Regency, and to identify the supporting and inhibiting factors that influence the success of the mediation process.

Methodology – This research uses a qualitative method with a descriptive approach. Data were collected through direct observation, interviews with relevant informants, and documentation of divorce case records from 2021 to 2023.

Findings – The results show that the success rate of mediation remains low. In 2021, only 8.3% of cases were withdrawn after successful mediation; in 2022, the figure rose to 13.3%, and in 2023 to 15.1%. Supporting factors include openness between parties, mediator empathy, presence during mediation, and equality in the process. Inhibiting factors include a strong desire to divorce, prolonged conflict, psychological issues, and the absence of one party

Originality/Novelty – This research is unique in its focus on the effectiveness of mediation within the local context of the Religious Court of Pangkalan Kerinci, a topic that has rarely been studied. By analyzing both internal and external factors, the study offers a new and comprehensive perspective.

 Implications – The study implies the need to improve the quality and capacity of mediators, strengthen internal court regulations, and enhance public legal education regarding the importance of mediation in dispute resolution. The findings can also serve as a basis for policy development to promote mediation as a more humane, restorative, and non-litigation solution in family law cases.
